These Terms of Service (“Terms”) govern your use of pedalcrestcycles.com and any purchase you make from Pedalcrest Cycles LLC. By using our Site or placing an order, you agree to these Terms.

Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. Orders can only be shipped to addresses in the United States.

Products and pricing

We make every effort to display our products, specifications, colors and prices accurately. Product images are representative, and actual colors may vary slightly depending on your screen. All prices are listed in US dollars (USD). Applicable sales tax and shipping charges are shown at checkout before you complete your purchase.

If a product is listed at an incorrect price due to an error, we reserve the right to cancel any orders placed at the incorrect price. If your payment has already been charged, we will issue a full refund.

Orders and acceptance

Your order is an offer to buy. We accept your order when we ship it and send you a shipping confirmation. We may refuse or cancel an order for reasons including product availability, errors in product or pricing information, or suspected fraud. If we cancel your order after you have been charged, we will refund you in full.

Payment

We accept the payment methods described in our Payment & Pricing Policy. By submitting payment information, you confirm you are authorized to use that payment method.

Shipping, returns and warranty

Shipping, returns and warranty coverage are governed by our Shipping Policy, Return & Refund Policy and Warranty Policy, which are part of these Terms. Title and risk of loss pass to you when the product is delivered to the carrier.

Safe use of products

Cycling involves inherent risk of injury. Always wear a properly fitted helmet, follow local traffic laws and read the owner’s manual before riding. Bicycles must be properly assembled and adjusted before use; if you are unsure, have a qualified bike mechanic inspect your bike. E-bike riders must follow local laws regarding e-bike classes, age limits and where e-bikes may be ridden.

Intellectual property

All content on this Site, including text, images, logos and design, is owned by or licensed to Pedalcrest Cycles LLC and may not be copied or used without our written permission.

Limitation of liability

To the fullest extent permitted by law, Pedalcrest Cycles LLC is not liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms limits any rights you have under applicable consumer protection law that cannot be waived.

Governing law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Multnomah County, Oregon, unless otherwise required by law.

Changes

We may update these Terms at any time by posting the revised version on this page. Changes do not affect orders placed before the change.
